1. Agreement to Terms
By accessing or using GameShift ("the Platform"), operated by Honeycomb Protocol, Inc., you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.
We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.
2. Eligibility
To use GameShift, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be located in a jurisdiction where cryptocurrency transactions are prohibited by law
If you are under 18, you represent that you have your parent's or guardian's permission to use the Platform. Users in jurisdictions where cryptocurrency is prohibited may not use the Platform's blockchain features.
3. Account Registration
When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
You may not share your account or allow others to access it. We reserve the right to suspend or terminate accounts that violate these terms.
4. Digital Assets and Wallet Services
GameShift integrates with blockchain technology and digital wallets. Wallet services are provided by MetaKeep (metakeep.xyz), a third-party custodian. Your use of wallet services is also subject to MetaKeep's terms of service.
By using these features, you acknowledge:
- Irreversibility: Blockchain transactions are irreversible. We cannot recover lost assets or reverse transactions once confirmed on the blockchain.
- Volatility: Digital assets may fluctuate in value. We make no guarantees about the value or liquidity of any digital assets.
- Network fees: Blockchain transactions may require network fees (gas) that are outside our control.
- Wallet access: You are responsible for maintaining access to your wallet through the MetaKeep service.
5. Marketplace
GameShift may offer a marketplace where users can buy, sell, and trade digital assets. If you use the marketplace:
- You may set your own prices when listing items for sale
- Transactions occur directly between users
- Platform fees may apply to transactions
- Payment methods may include credit cards and cryptocurrency
- We may assist with disputes between buyers and sellers but are not obligated to do so
- Completed blockchain transactions cannot be refunded
6. Acceptable Use
You agree not to:
- Use the Platform for any illegal purpose or to violate any laws
- Harass, abuse, or harm other users
- Post content that is hateful, threatening, pornographic, or incites violence
- Impersonate others or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Use bots, scripts, or automated tools to interact with the Platform without permission
- Manipulate or exploit game mechanics, rewards systems, or leaderboards
- Engage in market manipulation or fraudulent trading activities
- Post spam, excessive self-promotion, or unauthorized commercial content in community areas
7. User Content
You may post content on the Platform, including forum posts, comments, and profile information. By posting content, you:
- Grant us a non-exclusive, royalty-free license to use, display, and distribute your content on the Platform
- Represent that you own or have the right to share the content
- Agree that your content does not violate these terms or any third-party rights
We may remove content that violates these terms without notice. We are not responsible for user-generated content and do not endorse any opinions expressed by users.
8. Intellectual Property
The Platform and its original content (excluding user content) are owned by Honeycomb Protocol, Inc. and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works from any part of the Platform without our express written permission.
9. Third-Party Games and Services
GameShift features games and services provided by third parties. These may have their own terms and conditions. We are not responsible for third-party content, services, or practices.
Gambling disclaimer: GameShift does not operate or endorse gambling. Some third-party games listed on the Platform may include chance-based mechanics or wagering features. Users are responsible for verifying the legality of such activities in their jurisdiction before participating.
10. Rewards
If GameShift offers rewards, points, or incentive programs, the following applies:
- Rewards have no cash value and cannot be exchanged for currency
- Reward programs may be modified, suspended, or terminated at any time
- Rewards may be forfeited if you violate these terms
- Rewards are non-transferable unless explicitly stated otherwise
11. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for any losses resulting from your use of the Platform, including loss of digital assets.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONEYCOMB PROTOCOL, INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR DIGITAL ASSETS.
Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Honeycomb Protocol, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these terms.
14. Dispute Resolution
If you have a dispute with us, please contact us first at support@gameshift.gg. We will attempt to resolve the dispute informally within 30 days.
If we cannot resolve the dispute informally, any legal action shall be brought in the state or federal courts located in the State of Delaware, USA.
15. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Platform ceases immediately
- We may delete your account and associated data
- Any digital assets in your wallet remain accessible via the blockchain through MetaKeep
16. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
